Regulation of Export of Powdered Formula (including milk powder and soya milk powder)

The Import and Export (General)(Amendment) Regulation 2013 has commenced since 1 March 2013 to include powdered formula (including milk or soya milk powder) for consumption by infants and young children under 36 months as a prohibited article in the second column of Part 1 of Schedule 2 to the Import and Export (General) Regulations (Cap 60A). According to the Import and Export Ordinance (Cap 60) (“the Ordinance”), no person shall export (including by post) any prohibited articles including the above-mentioned powdered formula to any places outside Hong Kong except with an export licence issued by the Director-General of Trade and Industry (unless otherwise provided in the legislation).

Any person who contravenes the Ordinance in respect of powdered formula shall be guilty of an offence and shall be liable on conviction to a fine of $500,000 and to imprisonment for two years.
